Forever Memories Productions agrees to work with the client to create a Event Package that meets their specifications. Forever Memories Productions agrees to incorporate the client's suggestions and ideas into the package. The client is to make all design and editorial suggestions before the creation of the package, or grant editing rights to the Forever Memories Productions staff. After the client has received the package, changes can be made free of charge only (1) if Forever Memories Productions failed to meet the specifications given by the client prior to contract (2) names, dates, text are incorrect according to the order form filled out by the client.

Forever Memories Productions reserves the right to eliminate photographs from the Montage and/or Video Short due to music selections and timing. Videos/Photos considered to be obscene or offensive will be deleted. We also reserve the right to crop, color correct, or retouch any video/photograph used in the package to increase visual appeal. Forever Memories Productions is not responsible for video/photographs that appear to be slightly darker/lighter than the original video/prints, as specific colors may not appear to be the same on a television screen. All attempts will be made, however, to produce accurate representation of each video/photo.

The client is responsible for selecting each photograph for the purpose of specifying the order in which they are to appear. Forever Memories Productions will make every attempt to place the photos in the exact order requested, but does not guarantee the exact order specified. If no order is specified, Forever Memories Productions will attempt to categorize the photos chronologically. In this case, Forever Memories Productions is not responsible for photos that appear in the incorrect order. In the event that the incorrect information is included in the package as a result of incorrect information provided in the order form (e.g. spelling etc.), it is the financial responsibility of the client to purchase an additional copy with the correct information (standard editing applies).

The due performance of this agreement is subject to alteration or cancellation by Forever Memories Productions owing to any cause beyond their control. Forever Memories Productions takes the utmost care in respect to servicing the client's needs.  Every care is taken in recording, scanning, designing, and processing using professional materials. In the unlikely event of total technological failure, or any extenuating circumstances that prevent the package from being delivered on time Forever Memories Productions liability shall be limited to a full refund of all money paid for the event package. In the event that a package is damaged during the shipping process, Forever Memories Productions will ship a new package to the client (at no additional cost) upon the client's return of the damaged package. If you cannot play the DVD on your specific player  then Forever Memories Productions will provide you with a copy on VHS and/or a reformatted DVD.

Liability: Delivery of any photographic material/movie/video clip/tapes to us including electronic images for processing or any other purpose constitutes an agreement by you that if the material is damaged or lost by us, even though by negligence, or other fault, OR BY GOD'S ACT, we at Forever Memories Productions are not responsible. Our handling of photographic material as well as electronic images and video clips, is without any warranty or liability. Every effort will be made to take care and protect your photographs, including the delivery of CD/DVD.

Copyright: You, the customer, are guaranteeing that no copyright infringements will take place as a result of the process you request, and that you will be responsible for any copyright infringements committed as a result of the service. Client warrants that the videotape, film, photos, slides or other media submitted to Forever Memories Productions for processing is not protected by a third party copyright owner or if protected, the client has obtained permission of such third party copyright holder to make copies. Client also agrees to protect and indemnify Forever Memories Productions from any costs related to copyright infringement.

The Copyright of all packages is retained by Forever Memories Productions. Reproduction by video or any other means is prohibited. Original files remain the property of Forever Memories Productions and may be used for advertising, display, or any other purpose seen appropriate. In return, Forever Memories Productions agrees to use the package in good faith and in good taste.

Music used in our video editing is copyrighted material by which Forever Memories Productions does not hold copyrights. By submitting an order form and agreeing to Forever Memories Productions terms of service, clients agree that they have purchased and possess their own original copy of all music used in their video. You can avoid this by having us use royalty free music.

Professional portraits should not be submitted and will not be used unless permission has been obtained from the photographer. The photographer holds all copyrights to their images, and must agree to their use in your package. Some photographers will agree to include their works when their name is attached. This is acceptable by Forever Memories Productions.

Payment: A 25% deposit of the total Package Price is required to approve this contract and is NON-REFUNDABLE.  It shall be liquidated damages to Forever Memories Productions in the event of a breach of contract by client. Balance is expected to be paid in full the day of the Event.  Any bank charges incurred due to returned checks will be charged to the client along with a $35 insufficient funds fee. All personal checks must clear before package is delivered with no exceptions. Payment is non-refundable.

It is mutually agreed that the above terms form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Forever Memories Productions in writing.  Any portion herein may be amended, including any policies and procedures, at any time without client notice.  Any claims made by Forever Memories Productions prior to this contract are binding, provided a written evidence or mutually agreed upon by both parties.  Fees, rates and/or related costs may be changed to reflect current events, supply/demand and/or emergency use. The only AUTHORIZED account from FMPny to make Contract, billing, price and/or satisfaction resolution is from sales@fmpny.com.

By  signing the contract to Forever Memories Productions we will assume that you have read and agree to the above terms  and understand this Customer Service Agreement.
